What to do if you are the legal representative of a legal entity


Since 2017, the legal representatives of a legal entity – such as a public limited company, private limited liability company, simplified joint stock company, single-member private limited liability company, non-profit, local authority, or public establishment – are required to designate the driver who has committed an offence while driving their vehicle (Article L.121-6 of the French Highway Code).

Lorsque le représentant légal ne désigne pas l'auteur de l'infraction, la personne morale encourt une amende forfaitaire égale à 675 euros, majorée à 1875 euros.

En cas de contestation, le tribunal de police pourra prononcer une amende maximale de 3 750 euros et décider de sanctionner le représentant légal d'une amende pouvant atteindre 750 euros (voir la réglementation).

 

Avant de payer votre amende vous devez soit

 

1/ DESIGNATE THE DRIVER OF THE VEHICLE

 

You must designate the person who was driving the vehicle at the time the offence was recorded (even if you were the driver), otherwise you will receive a traffic violation notice for failure to designate. The person designated will then receive a traffic violation notice in their own name and can pay the fine.

You must select option No. 2 "I am self employed" and designate the driver.

Make sure you have:

  • Tthe traffic violation notice you received
  • The name, contact details, and driving licence details of the person who was driving the vehicle when the offence was committed

 

You can also submit the designation by filling in the "exoneration request form" (the blue sheet attached to the traffic violation notice) and following the instructions, then sending it by registered post with acknowledgement of receipt to the public prosecutor's office whose details are printed on the back of the notice.

2/ APPEALING AND REQUESTING AN EXEMPTION

 

If you are the victim of registration plate fraud, vehicle theft, or any other event beyond your control, you can appeal against the traffic violation notice.

Make sure you have all the documents and proof you may need: e.g. the traffic violation notice, a police report receipt (if the vehicle has been stolen), vehicle destruction certificate, declaration of sale, and/or any other relevant proof.
