If the offence was not committed by the person who received the initial fixed penalty notice, the latter need only appeal against the fine, citing the "loan or hire" case and designating the 2nd co-owner.
Being listed as a co-owner on the vehicle registration certificate falls under this category, although it is not strictly speaking a loan or exemption request, despite the name on the form. The co-owner will then receive a new fixed penalty notice with updated payment deadlines, and, if applicable, points will be incurred for the offence.
IMPORTANT: Do not pay the initial fine, as this would mean the 1st co-owner incurs points despite not being the person who committed the offence. As a reminder, according to article L233-1 of the French Highway Code, payment constitutes acknowledgement of the offence and triggers the end of public prosecution.
There are two ways of carrying out the designation:
- Online via "Designation or appeal" by entering the exact wording that appears on the fixed penalty notice.
- By post, by filling in the blue sheet of the exemption request form that was sent with the fixed penalty notice, then sending it by registered letter with acknowledgement of receipt to the Public Prosecution Officer (PPO), whose contact details are provided on the form. The PPO, as representative of the judicial authority and under supervision of the Public Prosecutor, is the only authority competent to decide on the admissibility of appeals.
The co-owner will then receive a new fixed penalty notice with updated payment deadlines, and, if applicable, points will be incurred for the offence.
Please note that, in some very rare cases, the Vehicle Registration System may provide ANTAI with incomplete co-owner names if they exceed 38 characters. This could result in truncated names on fixed penalty notices.
